H1B 每年有一定的年度配額，20,000 優先配是分配給有碩士學位者，65,000 給其他一般申請者，但若有碩士學位申請者擠不進 20,000 配額，則也可一起參與 65,000 的配額.
H1-B的年度是每年的十月至明年的九月，且在每年的四月一日就可開始提出申請.
不像今年2009 年的 2010 年度的 H1B visa 還尚有名額, 在過去這幾年因為四月一日就已收到近 100,000 件的申請，所以在過去有所謂的 H-1B 抽籤，這樣的抽籤與綠卡抽籤是不同的.

Unfortunately, there is no grace period if you or your employer terminate your H-1B employment. If you worked to the expiration date of your H-1B (Sept 2012), you would be entitled to a 10 day grace period.
Being out of status or overstaying may affect your ability to obtain future nonimmigrant visas. If you plan to stay in the U.S. to wrap up your affairs, one option is to change status to a non-immigrant visa such as B-2, tourist visa. Please keep in mind, the change of status application must be received by USCIS while you are still in valid status. Our law firm offers change of status application services.

If done properly, you do not need to go back to Taiwan to change status to B2.
