Accrual of unlawful presence for F, J, M visa

In the past, foreign students and exchange visitors (F and J nonimmigrants, respectively) who were admitted for, or present in the United States in, duration of status (D/S) started accruing unlawful presence on the day after USCIS formally found a nonimmigrant status violation while adjudicating a request for another immigration benefit or on the day after an immigration judge ordered the applicant excluded, deported, or removed (whether or not the decision is appealed), whichever came first.

USCIS is now changing its policy on how to calculate unlawful presence for F-1, J-1, and M-1 nonimmigrants, and their dependents (F-2, J-2, and M-2). This new policy on the accrual of unlawful presence with respect to F, J and M nonimmigrants will take effect on August 9, 2018. The policy for determining unlawful presence for aliens present in the United States who are not in F, J, or M nonimmigrant status remains unchanged.

2013 H-1B 已達年度名額

美國移民局已於六月十一日發布 2013 H-1B 已經達到年度名額申請人數而不再收件，因此任何在六月十一日後遞件申請者並不受理!

H1B 估本月額滿 申請趁早

美國移民局在五月二十五日H-1B (非移民短期工作簽證) 一般名額已經收到 48,400 件申請，而碩士學位名額也已達 17,500 件.


目前預估 2013 H1-B 會計年度( 2012 年10月至2013 年9月) 名額將在1-3 星期內，也就是六月份即告用罄, 這是經濟回溫的現象, 欲申請 H1B 者需愈快遞件愈好，至於以下三類 H1B 仍不受限於年度配額:

H1B 申請即將於 2012 年四月二日開始 ( 2013 年度 )

2013 年度的 H1B 申請即將於2012 年四月二日開始, 而可正式以H-1B 身份工作開始日為十月一日以後.

H1B 一般配額人數為 65,000, 碩士學位以上配額為20,000.

H1B 簽証有效期為三年，可再延長三年，也就是總共為六年，在特定情況下也可再延長。

USCIS unexpectedly announced the H-1B statutory cap of 65,000 for fiscal year (FY) 2012 has been reached.


Nov. 22, 2011 was the final receipt date for new H-1B specialty occupation petitions requesting an employment start date in FY 2012 (Oct 1, 2011-Sept 30, 2012). The statutory cap of 20,000 for the advance degree applicants was reached on October 19, 2011.

美國工作簽証 H1B 請把握申請時間

至十一月二日美國移民局已收到 50,800 件的H-1B一般額度(65,000) 申請，而碩士學歷以上的20,000 配額已經額滿. 

目前預估2012 年度的 H1B 會在十二月左右額滿，因此若你的雇主願意幫你申請且你計劃使用 H1B 在六月以前工作, 請把握申請時間. 

Tri-Valley University Accused of Immigration Fraud

Tri-Valley University (TVU), a little known Pleasanton, California school, has been accused of being a sham university that illegally provided I-20s to foreign nationals. As of December 30, 2010, the school had 1,613 active and 966 initial F-1 students with approximately 95% of the students from India. The tuition at the school was $2,700 each term so the school would have generated about $7,000,000 in revenue in the spring 2011 term alone. The school offered three terms per year.

O-1 簽証

若無大學文憑或同等的工作經驗，又或者H-1B 的配額不夠時，O-1 可以是另一個可以提供參考的選擇. 

O-1 包括的領域有:

美簽 H-4、 L-2、 F-2 Visa

H-4 visa: 

The H-4 visa is available for spouses of H-1B visa holders. The H-4 visa does not allow the visa holder to work. The H-4 visa can be converted to an H-1B or F-1 but there are many obstacles such as onerous requirements of the H-1B and the high cost of education in the US . This results in many spouses who were working and successful in their country being stuck at home in the US .   

L-2 visa: 

F1 學生簽証 + OPT : 工作篇

持 F-1 Visa 的學生可以馬上在校園裡工作，但在校外工作 ( 除非是與學校有聯盟關係的教育機構 ) 的話則必須要等一學年後. 且因持學生簽証主要是來美國念書而不是工作，所以即使要在校外工作通常還要符合一些要件: 

1)      無預期的、不可抗拒的嚴重經濟因難. 除了一些特別例外，前題是你還是必需保持你的學生身份，繼續念書以維持規定的時數，並且在學校開學期間每星期工作不超過20 小時.

OR

F1 學生簽証

F-1 學生簽証是屬於非移民簽証類，意即你並沒有意圖放棄你原生的所在地，所以這樣的 Visa 是暫時性的 (意即你沒有要永久居住在美國)，其目的是讓你來美國追求學業，且必需是移民局已認可的學術機構，並且有遵循 SEVIS 規定. 

但持 F1 簽証不能來美就讀公立的中小學，或參加公立中學就讀不超過一年且自付全額學費. 違反此規定者將不得入境美國 5 年. 但此規定不適用於 J1, F2, L2 or H4. 

逾期居留 ( Overstay )

持非移民簽証，例如: 學生簽証 ( F1 )、觀光簽証 ( B2 ) 等, 入美時都必需填寫小白卡 ( I-94 ), 至於持 B2 簽証的人，在小白卡上會被註記何時這個 Visa 會到期 ( Expire).

所以當你在美待超過小白卡上允許的時間時，你就是逾期居留了 (Overstay)，除非你有適時申請延長或改變身份 ( Extensions of Stay or Change of Status ).
