21歲了，綠卡拿的到嗎？

21 歲在美國是非常重要的一個人生階段，你可以開始出入賭場，也可以開始買酒、喝酒. 
對很多美國人而言，21歲是一個開心的年齡，但在美國移民法上，卻是很多移民的夢靨！

過去當阿姨、叔叔幫甲的媽媽或爸爸申請綠卡，但就在綠卡快申請出來時，甲滿 21 歲了，所以甲就不能與媽媽、爸爸同時拿到綠卡，而要重頭來過.

但自從2002年通過了 “Child Status Protection Act”, 很多人雖滿21歲，但也可以與媽媽、爸爸一起拿到綠卡. 

但不要忘記你只有一 年的黃金時期，或至少 有請教移民律師，並 File 了一些 Forms , 要不然你的權益就喪失了. 

有些人申請移民，因對綠卡的困惑、害怕，而找了不了解美國移民法、或讓不知移民的最新法令的人辦理，造成很多人不知他們有受到新法保護，誤以為自己過了21歲就不能與父母同時拿綠卡，而不知其實有新法保護他們，而沒有 "Age-Out" 的問題，而白白錯失了他們的權益.

但即使你因錯失了上述所說的一年黃金時期因為不知有CSPA，也可以利用 Motion to Reopen， 因移民局在 2008年 五月出的一個 Memo, 但目前這個 Memo只適用在某些情況，才能 Reopen your case, 但也有人嘗試去 Expand or Relax 這個 Memo 的適用範圍. 

又或者雖 CSPA 沒有適用到你 (因即使利用 CSPA 的公式來算，你還是滿了 21歲)，近來也有成功的案例，也就是利用案例裡的Arguments, 就是你可以從 4th Preference 被自動歸為依親類的 2B, 而且還可以享用你媽媽、爸爸的優先日. 這樣一來，也比完全重新來過的好，也省了不少時間.
